Accepting our Terms and Conditions
1-a) All agreements relating to the deliver of the holiday club by Ballerz Ltd to the child/children are subject to these Terms to the exclusion of all other terms and conditions
1-b) No variation or addition to the Terms shall be binding unless agreed in writing by Ballerz Ltd and the Parent.
1-c) Our terms will be acknowledged and accepted by the Parent or Carer upon booking and payment of the fee or on behalf of the Parent.
 
Bookings
2-a) By booking a place for your child on any of our holiday clubs you agree our Terms and Conditions.
2-b) Ballerz Ltd offers an online booking and payment service. Once the booking form has been completed and submitted that will be confirmation of your booking via emailed receipt. Payment can be made either online safely through our website or via cash on the day. Bookings are subject to these Terms and Conditions together with out website terms and conditions which are hereby incorporated.
2-c) Receiving an email or text message from Ballerz Ltd is acknowledgement of your request to book a child on a Ballerz Holiday Club. Your booking receipt will be emailed to you and this is confirmation of your booking at the club. 
2-d) In the interest of health and safety and safeguarding, we can only guarantee a place on ANY course to those who book in advance. Those that arrive on the day will not be guaranteed a place on the activity and could be turned away.
2-e) Please ensure your child can attend the holiday club before you make a booking. It is the parents/carers responsibility to ensure that the child meets the conditions for attending the holiday club. If you make a booking for your child then make arrangements for your child then your booking will not be refunded. 
2-f) Ballerz Ltd may cancel the agreement between the Parent/Guardian and at any time before the course for any reason deemed relevant and necessary. Ballerz shall not be liable for any loss or damage whatsoever arising from such cancellation.
2-g) In the unlikely event of a cancellation by Ballerz Ltd prior to the attendance of the Holiday Club by the child, Ballerz will refund any fees outstanding within 30 days.
2-h) If your child is ill or cannot attend the Holiday Club for any reason, there will be no refund provided, however, the day(s) can be carried over to another day within the same Holiday Club or to the following Holiday Club for example if you are unable to attend in February you can carry over to Easter only. If Ballerz agree for you to carry over days your child has missed due to circumstances beyond your control this will only be carried forward to one camp in advance. 
 
Payment
3-a) The whole payment shall be paid to Ballerz Lt prior to the Pupil commencing the Holiday Club. If the fee is not paid, the child/children will not be able to attend for that day unless agreed otherwise by Ballerz.
3-b) The payment is non-refundable under any circumstance whatsoever except within the prior written agreement of Ballerz Ltd.
3-c) If our holiday club is cancelled due to an ‘Act of God’ (e.g. disruption resulting from extreme weather conditions, earthquakes etc) strikes, terrorist activity or where local authorities/public guidance advice that delivery should be temporarily suspended for health or other reasons, then no refunds will be given.
 
Parents Responsibility
The parent permits and represents that:
4-a) When attending the Holiday Club, neither the child nor the carer will be suffering from any contagious illness, disease or anything similar.
4-b) The parent recognises and accepts that the child shall be deemed to be under the direction, care and control of the Carer throughout the holiday club and the Carer shall be responsible for the welfare and behaviour of the child throughout the holiday club and while the pupil is at the venue. Should issues arise where Ballerz deem the child's behaviour does not meet the expected requirements of Ballerz staff, then the parent will take responsibility for this and the child would be collected from the club. No refund will be given in this instance. 
4-c) The parent shall insure and keep indemnified Ballerz Ltd against all loss (including loss of profit), liability, costs and expenses which Ballerz Ltd shall incur directly as a consequence of any action of inaction of the Parent, the Carer or the Child.
4-d) Any Special Educational Needs (SEN), Child Protection and Safeguarding information in relation to their child MUST be reported to the Company Director / Camp Manager for the health, safety and protection of that child. By booking your child on a Ballerz Holiday Club you are agreeing to adhere to the terms and conditions and responsibilities listed above.
4-e) You agree to compensate us, and/or any of our affiliates, directors, and employees, immediately on demand, against all claims, liability, damages, costs and expenses including legal fees, arising out of any breaches in the Terms and Conditions by you or any other liabilities arising out of your use of the website.
4-f) It is the parents responsibility to make sure that the child attends the holiday club within a timely manner. Drop off is between 8.30am and 9.15am each day. Any parent arriving after this without notifying Ballerz can be turned away. 
4-g) It is the parents responsibility that children are collected at the correct time. The holiday club finishes at 4.00pm with collection taking place between 4.00pm and 4.15pm. Any parent collecting the children later than 4.15pm will incur a late charge. 
4-h) Parents who collect children later than 4.15pm will incur the following late charges;
1-10 minutes late = £5
15+ minutes late =  £10
30+ minutes late = £15

 
Behaviour
5-a) Ballerz Ltd we have high standards of behaviour expectations from all children and rules in place for the children to adhere to. In the event that Ballerz determines the behaviour of the Pupil and/or the Carer to be unacceptable, Ballerz shall be entitled to exclude the Pupil and the Carer (or either) from the Holiday Club and Venue temporarily or permanently, as Ballerz shall determine.
5-b) The standard of behaviour which is to be regarded as unacceptable at a Course or at the venue shall be determined by a Ballerz Ltd Operating Director or Camp Manager.
 
Lunchtime
6-a) It is the duty and obligation of the Parent/Carer to provide a substantial and suitable lunch meal for children to have along with providing snacks for children to have in the morning and afternoon break.
6-b) Children will not be allowed to leave the premises and go off site for lunch even with parental permission.
6-c) Fruit and water will be provided at every holiday club on every day for the children.
6-d) Any Ballerz coach has the right to contact a parent if they believe a child to have an insufficient amount of food for lunch. This may also be noted and reported to our Safeguarding Lead.
 
Photography/Film
7-a) Ballerz will have a photographer on site at our Holiday Clubs and will take photographs/film. The use of this data is solely for the purpose of Ballerz Ltd literature, website, social media, leaflets, banners, press and TV and for use with partners that Ballerz Ltd company director deems appropriate.
7-b) Parents/Guardians MUST sign our image policy giving consent for their child to be photographed/filmed. Any parents/guardians that do not wish for their child to be photographed/filmed must inform the head coach of the holiday club so this information can be stored and communicated to our photographer. Where possible this information should be provided before attendance of the holiday club via the booking form.
 
Communications
8-a) We like to communicate with our parents in the easiest and friendliest way. We may send you communications via leaflet, e-mail or text message.
8-b) We would like you to visit and engage in our Facebook page, Twitter and Instagram and receive up to date information regarding anything and everything Ballerz Ltd.
8-c) We would like you to feel free to communicate with us via phone, e-mail or social media at anytime.
 
Child Protection
9-a) All Ballerz Ltd staff hold current child protection and DBS certification. In the event that a child makes a disclosure or a member of staff believes that the child is suffering from abuse we will act in accordance with our child protection policy. A copy of which is available on request from Ballerz Ltd management. If  a disclosure is made or a member of the Ballerz team is concerned about a child being abused or neglected, then the Child Protection Officer for that establishment (the child’s school) will be informed as a matter of urgency by our Safeguarding Lead.
9-b) All Ballerz staff are encouraged to report any child protection issues to the head coach / company director who will document any concerns and then liaise with the Ballerz safeguarding lead.
 
E-Safety
When using the website you should always take the following precautions
10-a) Always keep your identity private. Do not give out your full name, postal address, phone number, e-mail address, the name of your workplace or school or any other information (other than what is specifically requested by us), that could help someone discover your identity.
10-b) Never meet someone you meet online
10-c) Do not reply to any hostile, rude or inappropriate messages. Report these immediately. Let us know about them by e-mailing us directly so we can address it.
 
Use of the site
11-a) Any use by you of our Website / Social media pages will be under the following conditions
11-b) You must not post onto or otherwise make available on the website any defamatory, harmful, obscene or pornographic material or material which would violate or infringe in any way the rights of others (including rights of privacy). You must not cause distress or inconvenience, which does not comply with relevant laws, and you must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive. Always treat others with respect and encourage your children to do the same if they are accessing the website/social media pages. Any comments or posts (relevant to the above) on or including the Ballerz page will be reported immediately.
11-c) You may not copy, download, reproduce, republish, broadcast, transmit in any manner whatsoever any content from our website without our permission from Ballerz Ltd.
11-d) Whilst on the website you agree to comply with all applicable UK laws and regulations.
 
Liability
12-a) Neither us, nor any of our directors, employees or otherwise representatives will be liable for damages, in contract or otherwise including negligence, arising out of or in connection with the use of the digital service. You confirm that we shall not be liable to you or any third party for any modification to, suspension of or discontinuance of the digital service.
12-b) Protectivity Insurance provides Ballerz Ltd Public Liability insurance
12-c) Other than in relation to death, personal injury, or property damage where Ballerz Ltd or its staff is proven to be negligent, Ballerz Ltd’s liability to you is limited to the booking fee paid by you.
12-d) Content which is posted on any Ballerz Ltd communications is written or produced by users and we are not responsible for and give no endorsement of such content. We reserve the right to monitor contributions and may respond to or comment upon communications by you and edit, refuse to post or remove any content from any bulletin boards and chat forums in our absolute discretion. No failure to remove particular content constitutes an endorsement or acceptance of it by us.
12-e) We will endeavour to provide the Site using all reasonable care. To the extent permitted by law, we exclude all implied warranties as to quality, accuracy or fitness of the content and we do not warrant that the content, any of the functions contained in the Site and the server will operate without interruption or delay or will be error free, free of viruses or bugs or is compatible with any other software or material.
12-f) We reserve the right, at any time, to modify, alter, or update these Terms and Conditions, and you agree to be bound by any such modifications, alterations or updates which are posted on the Site.
12-g) Ballerz Ltd its coaches, servants, employees or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay suffered or incurred by the Parent, the Pupil or any other party arising directly or indirectly or in any way connected with the attendance of the Pupil at the Course (or any part of it) or any other act or omission on the part of Ballerz Ltd or any of its coaches, employees or agents even if such act or omission is negligent.
12-h) The Parent agrees (for and on behalf of the Parent and the Pupil) that any claim by the Parent or the Pupil against Ballerz Ltd or any coach, employee or agent of Ballerz Ltd must be brought within 30 days of the event that gave rise to such claim. Any claim made thereafter shall be time-barred.
12-i) The Parent acknowledges, warrants and undertakes (for and on behalf of the Parent and the Child) that the maximum aggregate liability of Ballerz Ltd to the Parent and/or Child under these terms shall not exceed the Fee.

Holiday club changes
14-a) In the event that Ballerz Ltd has to cancel a holiday club for any reason, a refund for the full value of the booking fee paid will be issued to the person who booked or alternative provisions to stage the course at another time will be arranged and confirmed to all, if you are unable to attend at the alternatively arranged time and confirm this to Ballerz Ltd, Ballerz Ltd will issue a full refund.
14-b) In the event of inclement weather, all Ballerz Ltd courses have suitable indoor areas to change, meet and eat lunch, and suitable indoor activities will be organised to replace the outdoor activities at the discretion of Ballerz Ltd.
 
Leaving an Activity
15-a) Drop off and pick up time can be flexible for parents but this must be communicated to the Ballerz staff prior to this happening, not on the day. Gates will be locked from 9.15am each day. If you need to pick your child up earlier or drop them off later then you must call for the gate to be unlocked. Early pick up must be at 3pm or before. No pick ups are allowed between 3pm and 4pm.
15-b) Any child that is collected must be collected by a parent or guardian and such parent or guardian must sign the child out of the course with a member of Ballerz Ltd staff. Any child that normally walks home unaccompanied from any course will only be allowed to leave unaccompanied if a parent or guardian has provided written consent prior to the commencement of the holiday club.
 
Personal Property / Devices
16-a) Ballerz cannot be held responsible for any loss or damage to any personal belongings whilst attending a Ballerz Ltd holiday club. Please ensure that your children take no valuables to any venue.
16-b) Children are permitted to bring phones, iPods, iPads, handheld gaming devices and tablets to be used during breaks ONLY. If you allow your child to bring any of the above devices you are agreeing to our terms and conditions and Ballerz will not be liable for any damages or loss to these devices.
 
Health and Safety
17-a) A full risk assessment will be carried out before any activity takes place at any venue. Ballerz Ltd staff hold a current emergency aid certificate issued by an appropriate body.
17-b) By agreeing to these terms and conditions you are providing consent for Ballerz Ltd staff to administer any and all necessary first aid to your child as required at any time.
17-c) It is the parent/guardian’s responsibility to ensure appropriate clothing is worn and/or available for their child for the course being undertaken and weather conditions. Children must wear appropriate footwear for sports activities.
 
Medical information
18-a) Any medical conditions that any participant may have must be fully disclosed (1) on the booking form (2) to the head coach at the holiday club or at the venue.
 
Complaints
19-a) In the unlikely event that you or your child are dissatisfied with the service we provide then please in the first instance raise it with the head coach at the holiday club. He/she will deal will the problem in accordance with our policies and procedures.
19-b) If the problem is not resolved to your satisfaction, then please write to our company director Aaron on ballerz.uk@hotmail.com within 7 days of child’s attendance on the course.
19-b) We take your views and complaints very seriously and will endeavour to resolve your complaint as quickly as possible. Refunds will only be issued at the discretion of the company director where deemed necessary.

20-a) Any emails and/or files transmitted with them are confidential and intended solely for the use of the individual or entity to whom they are addressed. If you have received any email in error please email ballerz.uk@hotmail.com immediately.
20-b) Any opinions expressed in emails are those of the individual and not necessarily those of Ballerz Ltd. Although Ballerz Ltd has taken reasonable precautions to ensure no viruses are present in our emails, we cannot accept responsibility for any loss or damage arising from the use of this email or attachments.

21-c) By booking a holiday club with Ballerz Ltd you are acknowledging your full acceptance of these Terms and Conditions and confirm that you have not relied on any other representation other than those contained within these Terms and Conditions.
21-d) These Terms and Conditions are governed by English law and subject to the exclusive jurisdiction of the Courts of England.

Glossary of terms
Terms and Conditions – means the terms contained in this document and any other document referred to within it.
Ballerz Ltd – the company with who you have entered into the contract and terms and conditions
Holiday club – any holiday club activity, club or event attended by you and delivered by Ballerz Ltd
Content – any and all of the content and material containing within the site including without limitation all text, graphics, photographs, audio and video.
Parent – a parent or legal guardian who is the contracting party to this agreement
Carer – the person / persons who accompanies the child to and from the course or any part of it
Coach – the individual(s) employed by Ballerz Ltd to deliver the sessions/events
Head Coach – the individual recommended by Ballerz Ltd to run the holiday club
The Business – Ballerz Ltd
Pupil – the child attending the holiday club, whose details are provided by the Parent or Carer on the online booking / on the day booking form (paper copy)
Users – the users of the Site collectively and/or of Ballerz services
We/our/us – Ballerz Ltd participants
Fee – the cost in pounds per course as specified on the leaflet/booking form/website
Website – a site on the Internet
You/your – you, the user
Premises – the premises/venue where the holiday club takes place
Terms – the terms and conditions set out in this document and any special terms and conditions agreed in writing by Ballerz Ltd and the parent

Where Ballerz is used in this document refers to the company name. Whilst every effort will be taken to maintain the consistency of the Coaches during the holiday club, Ballerz Ltd unreservedly retain the right to change the coaching staff where necessary and to suit the needs of the business.
